Disclaimer of Liability and Assumption of Risk
By purchasing and using Flex&Flow foldable reformer beds (“Product”), you (“Purchaser/User”) acknowledge and agree to the following:
1. Assumption of Risk
Use of the Product, including but not limited to setup, folding, unfolding, transport, and participation in Pilates or any form of exercise using the Product, involves inherent risks of injury, including but not limited to strains, sprains, falls, equipment failure, or other physical injuries. By purchasing and using this Product, you voluntarily assume all risks associated with its use.
2. No Liability
To the fullest extent permitted by local, national, and international laws, Flex&Flow, its owners, employees, agents, manufacturers, distributors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to bodily injury, property damage, loss of income, or death, arising out of or related to the purchase, use, setup, folding, unfolding, storage, transport, or misuse of the Product, regardless of whether such damages are based on warranty, contract, tort, or any other legal theory.
3. Proper Use
The User agrees to follow Flex&Flow Reformer Installation & Folding Guide regarding the safe use, folding, unfolding, and storage of the product and acknowledges that failure to follow such instructions may increase the risk of injury. The product should only be used by individuals with appropriate training, and Users should consult a physician before beginning any new exercise program.
4. Indemnification
You agree to indemnify, defend, and hold harmless Flex&Flow and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your purchase or use of the Product.
5. Warranty Policy
Flex&Flow offers a 2-year warranty, from the day the product is received and successfully installed. The warranty covers any removable components on the reformer, such as shoulder pads, poles, and straps. During the warranty period, if the product fails or is damaged under normal use according to the instruction manual, our maintenance partners will repair or replace it, free of charge.
After the warranty period, the User will be contacted by our maintenance partners. From here, the User has a choice whether they want to continue receiving maintenance from our partners for a fixed monthly payment.
5.1 Warranty Exclusions
- Please note that the Flex&Flow warranty does not cover:
- Damage caused by improper assembly, misuse, or unauthorized modifications
- Issues arising from transport once the item is successfully delivered and accepted
6. No Warranty of Injury Prevention
Flex&Flow makes no guarantees or warranties, express or implied, that the use of the Product will be risk-free or prevent injury.
7. Governing Law
This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Flex&Flow operates, without regard to its conflict of laws principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction.
